The Jeanne Clery Campus Safety Act is a federal law requiring colleges and universities participating in federal financial aid programs to maintain and disclose campus crime statistics and security information that occur not only on campus and on property adjacent to campus, but also in certain non-campus locations affiliated with the institution – this includes locations for university sponsored student travel (e.g., athletics, academic organizations, clubs). As such, faculty/staff who are administratively responsible for overnight student travel are expected to report student trip information by filling out the Clery Student Travel Form, thus allowing MSUB to determine whether the trip qualifies as Clery reportable.

Information on qualifying student trips is needed for following up with the local law enforcement agency associated with the trip location. Any Clery Act crimes that reportedly occurred during the time frame the university had control* over the space must be included in MSUB’s Annual Security and Fire Safety Report and reported to the Department of Education. 

*Control, per the Clery Act, refers to a written agreement (no matter how informal) directly between the university and the end provider for use of the space.

Under the Clery Act, the university is required to collect and publish statistics on crimes that have occurred on both MSUB and City College campuses, on public property within or immediately adjacent to each campus, and on non-campus property owned or controlled by the university.

Control, as defined by the Clery Act, means that there is a written agreement directly between the university and the provider of the space. For student travel to be reportable (i.e., a Clery Student Travel Form is required), there must be a written agreement, defined as a rental or lease document or other written form of agreement covering the university's use of academic and/or residential space. The agreement need not be a formal one; anything in writing agreeing to the utilization of space by MSUB suffices (including a letter, email, or hotel receipt).  It does not matter whether a fee is charged or if the agreement allows use of the space free of charge.   

If there is a written agreement, Clery reporting requirements apply for those areas specified in the agreement, as well as the common areas leading to those spaces (such as lobby, elevator, hallways, entryways, stairwells, etc.). This makes providing as much detail as possible on the Student Travel Form a necessity. Clery reporting requirements only apply for those dates and times covered by the agreement. For example, if a property manager agrees to provide a block of rooms for our students for eight weeks during the summer, information only needs to be reported during that time, not for the entire year

Field trips/day trips: You are not required to report field trips that are not overnight and are not at a MSUB-owned or controlled location.

Overnight trips: For university-sponsored overnight trips to be reportable, the trip needs to be repeated every year and students stay in the same hotel every year (consecutively).

Short Stay Away trips: For university-sponsored short stay away trips to be reportable, the trip needs to extend for more than one night. All locations used by students during the trip, controlled by the university during the trip (hotels and rented classroom space), and used to support educational purposes, should be reported on the Student Travel Form.

Other student travel situations:

  • Private home stays do not usually qualify as a reportable non-campus location.  Clery reporting requirements would only apply if MSUB has some kind of written agreement directly with the provider of the home or the host family. To be reportable, this contract would have to give MSUB significant control over space in the family home (such as an Airbnb rental agreement).
  • A study abroad program that includes an agreement with MSUB for overnight side trips to various locations and the same accommodations are used on a regular basis is Clery reportable.
  • Overnight side trips organized by the attending students or by host families that are not covered by an agreement with MSUB and are not officially organized by MSUB are not Clery reportable.
  • If MSUB directly or indirectly (e.g., uses a third party provider) rents, leases, or has some type of written agreement for the use of a building or property, or a portion of a building or property at another university, the written agreement gives MSUB control of that space for the allocated time period and is a Clery reportable location.
  • If MSUB has an agreement with another university to allow MSUB students to enroll at their institution, but does not provide housing or rent classroom space, there are no Clery reporting requirements.
