101.1 PURPOSE AND SCOPE

All law enforcement Chief Executive Officers employed within the State of Montana are required to meet specific requirements for appointment. This policy provides guidelines for the appointment of the Chief Executive Officer of the Montana State University Billings Police Department, who exercises the powers and duties of the office.


101.2 POLICY

It is the policy of this Department that the Chief of Police meets the minimum standards for exercising his/her authority granted by law.


101.3 CHIEF OF POLICE REQUIREMENTS

The Chief of Police of this Department, as a condition of employment, shall meet all requirements set forth by the state hiring authority.

The Chief of Police should not, during his/her term of office, practice law or otherwise act as an attorney, or have a law partner who engages in the practice of law.

The exercise of peace officer powers, including the power of arrest, by the Chief of Police requires successful completion of an appropriate course of training and certification as prescribed by the Montana Public Safety Officer Standards and Training (POST) Council (§ 7-32-303, MCA).
